Katsuba A.S., being an official holding a public position of a constituent entity of the Russian Federation - Deputy Chairman of the Government of the Khabarovsk Territory - Minister of Finance of the Khabarovsk Territory, deliberately committed actions that clearly went beyond the scope of his powers, namely, in September 2003 at his workplace at the Ministry of Finance of the Khabarovsk Territory at the address: st. Khabarovsk, st. Frunze, 72, in violation of budget legislation, entered into agreements with Amur Shipping Company OJSC, Dalreo OJSC, Daluglesbyt OJSC, Rybresursmarket LLC and Dalstroymekhanizatsiya OJSC to provide budget loans in the amount of 66 million rubles to each enterprise, in total for a total amount of 330 million rubles at 18% per annum with a repayment period of one year.

These agreements were concluded by A.S. Katsuba illegally, in violation of the requirements of Art. 76 of the Budget Code of the Russian Federation (as amended by Federal Law - 05.08.2000 No. 116-FZ), namely, without borrowers providing security for the fulfillment of obligations to repay the loan and without the Ministry of Finance of the region conducting a preliminary check of the financial condition of borrowers. At the same time, Katsuba A.S., by virtue of his official position, it was reliably known that in accordance with Part 8 of Art. 76 of the Budget Code of the Russian Federation, if borrowers are unable to ensure the fulfillment of obligations under a budget loan in one of the ways specified in the law (bank guarantee, surety, pledge of property in the amount of at least 100% of the loan provided), the budget loan is not provided.

Despite the fact that, according to the terms of the agreements, the purpose of the loans was to replenish working capital, these organizations used the funds received to purchase blocks of shares (620,000 shares each, which is 17.7%) of the bank OJSC CB Russian Investment Group (Russian Investment Group). Moscow). At the same time, in violation of the requirements of Part 6 of Art. 76 of the Budget Code of the Russian Federation during the period of validity of the loan agreements, the Ministry of Finance of the Khabarovsk Territory, headed by A. S. Katsuba, did not check the intended use of these budget loans.

Continuing to commit actions that clearly went beyond the scope of his powers, Katsuba A.S., from 2004 to 2007. in Khabarovsk entered into additional agreements with Amur Shipping Company OJSC, Dalreo OJSC, Daluglesbyt OJSC, Rybresursmarket LLC and Dalstroymekhanizatsiya OJSC, according to which the loan repayment terms were repeatedly postponed, up to 2008-2009 ., and interest rates on loans were illegally reduced for borrowers from the initial 18% to 15%, and then to 1.8% for Amur Shipping Company OJSC, Rybresursmarket LLC, Dalstroymekhanizatsiya OJSC and 0.1% for Dalreo OJSC , JSC "Daluglesbyt". At the same time, the effect of reducing the interest rate is extended to legal relations that arose from the moment the main agreements for the provision of budget loans were concluded, that is, from September 2003.

Katsuba A.S.’s changes to the interest rate on budget loans are unlawful, since budget legislation does not give the government authority the right to reduce or exempt from payment the amount of budget funds issued on a repayable basis, as well as interest rates and penalties for the timely return of these funds. On the contrary, by virtue of paragraph 2 of Art. 284.1 of the Budget Code of the Russian Federation, the heads of bodies executing the budgets of the constituent entities of the Russian Federation have the right to write off in an indisputable manner the amounts of budget funds subject to return to the budget, the repayment period of which has expired, and the amount of interest for the use of budget funds provided on a repayable basis, the payment period of which has come.

The commission of the above actions by Katsuba A.S., which clearly went beyond the scope of his powers, entailed a significant violation of the interests of society and the state protected by law, causing grave consequences, expressed in the fact that money was withdrawn from the turnover of the budget of the Khabarovsk Territory, which is subsidized, for several years funds in the amount of 330 million rubles, and as a result of the illegal reduction of the interest rate, the budget suffered damage in the amount of 232,738,283.79 rubles in the form of unpaid interest on the use of funds under contracts.

Thus, the actions of Katsuba A.S. show signs of a crime under paragraph “c” of Part 3 of Art. 286 of the Criminal Code of the Russian Federation (exceeding official powers) - the commission by an official of actions that clearly go beyond the scope of his powers and entail a significant violation of the interests of society and the state protected by law, committed by a person holding a public position in a subject of the Russian Federation, causing grave consequences.

The reason for initiating a criminal case is the report of investigator Ibiev R.K. on the discovery of signs of a crime, the basis is the presence of sufficient data indicating signs of a crime provided for in paragraph “c” of Part 3 of Art. 286 of the Criminal Code of the Russian Federation.

Taking into account that there is sufficient data indicating signs of a crime under paragraph “c” of Part 3 of Art. 286 of the Criminal Code of the Russian Federation, guided by Art. Art. 140, 145, 146, and part of the first art. 156 Code of Criminal Procedure of the Russian Federation,

1. Initiate a criminal case on the grounds of a crime provided for in paragraph “c” of Part 3 of Art. 286 of the Criminal Code of the Russian Federation.

The situation around the Minister of Finance of the Khabarovsk Territory, Alexander Katsuba, took an unexpected turn. Before the investigators of the Investigative Committee at the Prosecutor's Office (SKP) had time to initiate a criminal case, and we wrote about it, the case was immediately closed by other investigators - from the Prosecutor General's Office of the Russian Federation. Only three days passed between one procedural action and another. Moreover, the closure was given almost no publicity. Even on the official website of the Prosecutor General's Office of the Russian Federation there is nothing like this about this. Our editorial office was sent a copy of the resolution by email.

How the case was opened

Let us recall that the regional Minister of Finance was suspected of exceeding his official powers. According to the suddenly terminated investigation, the minister in 2003 issued a loan for 330 million rubles. five companies (Amur Shipping Company OJSC, Dalreo OJSC, Daluglesbyt OJSC, Rybresursmarket LLC and Dalstroymekhanizatsiya OJSC) that bought the Moscow bank OJSC CB Russian Investment Group.

As law enforcement agencies suggest, the minister could only do this if he was involved in the management of the companies... Otherwise, how can we understand that firms independent of each other, without any agreement, each purchased exactly 17.7% with budget money? shares of this Moscow bank? After the bank was “taken over,” a powerful cash flow began to flow through it. As a result of financial transactions, 7 billion rubles were cashed out.

According to the Central Bank of the Russian Federation, “at the end of October – November 2007, the activities of OJSC CB Russian Investment Group were focused on systematically conducting transit operations that have no obvious economic meaning on the accounts of a group of resident clients and correspondent accounts of some credit institutions.” Due to “repeated violations by the bank within one year of the requirements of the Federal Law “On combating the legalization (laundering) of proceeds from crime and the financing of terrorism,” the Central Bank of the Russian Federation revoked the license to carry out banking operations of OJSC CB Russian Investment Group.

The investigation also believed that Katsuba himself could well have imposed such a deal on five companies, and then, with additional agreements in 2004-08. reduced interest on loans - from 18% to 1.8%. Such loans are issued only with 100% collateral, but in this case they were not fully confirmed.

According to the investigator for especially important cases of the SKP R.K. Ibiev, “Katsuba’s commission of the above actions, which clearly went beyond the scope of his powers, entailed a significant violation of the interests of society and the state protected by law with the use of grave consequences, expressed in the fact that from the turnover of the Khabarovsk budget region, which is a subsidized region, funds in the amount of 330 million rubles were allocated for several years, and as a result of an illegal reduction in the interest rate, the region’s budget suffered damage in the amount of 232,738,283.79 rubles in the form of unpaid interest on the use of funds under contracts.”

On September 22, Mr. Katsuba was notified that criminal charges had been filed. On September 25 at 9.00 am, investigators from the Investigative Committee at the Russian Prosecutor's Office (when Moscow was still sleeping) began searches in the regional prosecutor's office, government and Ministry of Finance. All the required papers were given to Moscow investigators at the first request by the regional prosecutor himself, Vitaly Kaplunov. The documents concerned the April inspection of the prosecutor's office on the implementation of budget legislation.

The case was closed when it was already well after noon in Khabarovsk, and the working day began in Moscow. As Deputy Prosecutor General of the Russian Federation V.Ya. Grin writes in his resolution, “the decision to initiate a case against Minister Katsuba is illegal and premature, made without clarifying and taking into account the actual circumstances.” So what are these circumstances?

How the case was closed

It turns out that the budget codes of the Russian Federation and the Khabarovsk Territory, as well as the regional law on the budget system for 2003, did not provide for any restrictions on the use of budget loans. They did not cause damage to the regional budget, since, as stated in the resolution, “the funds issued in the form of loans were returned to the budget.”

Alexander Katsuba was also supported by deputies of the regional Duma. The people's representatives provided the prosecutor's office with the conclusion of the control and budget chamber of the Legislative Duma of the Khabarovsk Territory, according to which “the diversion of money to provide budget loans to legal entities did not have a significant impact on the execution of the regional budget for 2003.”

But that's not all. Quite unexpectedly, in the materials of the regional prosecutor’s office, Mr. Grin discovered a conclusion on checking the financial solvency of those five borrowing companies. This means that the investigation’s conclusions about non-compliance with the requirements of Article 76 of the Budget Code of the Russian Federation (on a comprehensive and thorough check of borrowers) when Katsuba issued loans become groundless. And according to the act of economic research of the Far Eastern Branch of the Russian Academy of Sciences (FEB RAS), “no damage was caused to the budget of the Khabarovsk Territory, since loans in the amount of 330 million rubles. returned, and 16.5 million rubles were paid. for the use of them in the form of interest."

Also, the deputy head of the supervisory department, Mr. Grin, noted that “the amount of unpaid interest indicated in the research report by the tax crimes department of the Khabarovsk Territory Internal Affairs Directorate cannot be considered direct damage in accordance with Art. 286 of the Criminal Code (“Excess of official powers”).” And right there in his resolution there is the following: “At the same time, this requirement is a fundamental feature of the crime.”

Be that as it may, the deputy prosecutor general makes a different conclusion: “The available materials do not contain data about A.S. Katsuba’s obvious excess of the powers granted to him.” Based on the above, “the decision to initiate a criminal case was made prematurely, without clarifying and taking into account all the factual circumstances, and therefore it is subject to cancellation, and the materials are sent for organizing additional checks.”

That is, the case is closed, but not quite! Checks are ongoing.

How to deal with this?
